6.1 Governing Law and Jurisdiction: These Terms, along with any related legal matters, shall be governed by and interpreted in accordance with the laws of the State of California, excluding any principles of conflicts of law. Any disputes arising from or related to these Terms shall be exclusively resolved in the state and federal courts located in the Northern District of California, and both parties consent to the jurisdiction of these courts, waiving any objections to venue.

These Terms shall remain binding on all parties, including successors and permitted assigns.
6.4 Arbitration Agreement: Both parties agree that any claims or disputes arising from or related to your use of the Site, Services, or any products or services offered through YourHomeQuotes.com shall be exclusively resolved through final and binding arbitration rather than in court. Prohibition of Class and Representative Actions and Non-Individualized Relief
Both parties agree that any claims shall be brought individually and not as a part of any collective, class, or representative action. The arbitrator shall not consolidate multiple claims or preside over any form of a collective proceeding. The arbitrator may issue relief only to the extent necessary for resolving an individual claim, without affecting any other users.
Arbitration Procedures
The arbitration shall be conducted by the American Arbitration Association (“AAA”) in accordance with its rules, including the Supplementary Procedures for Consumer-Related Disputes. AAA’s rules and forms for initiating arbitration are available at www.adr.org.
The arbitration will take place in the county of your residence or another mutually agreed location. If the claim amount is $10,000 or less, either party may elect to conduct arbitration solely based on written submissions or by telephone, subject to the arbitrator’s discretion.
The arbitrator shall apply the laws of the State of Michigan and respect applicable legal privileges. The arbitrator’s decision will be binding, and judgment on the award may be entered in any court with jurisdiction.
This arbitration agreement shall survive termination of these Terms and any use of or access to the Services or Site.
Arbitration Costs
Filing, administrative, and arbitrator fees shall be governed by AAA’s rules unless otherwise stated. If the claim is for $10,000 or less, YourHomeQuotes.com will cover all arbitration-related costs upon request. If the claim exceeds $10,000, and the user can demonstrate that arbitration costs would be prohibitive, YourHomeQuotes.com may contribute to costs as deemed necessary by the arbitrator. If the arbitrator deems the claim frivolous, the user agrees to reimburse YourHomeQuotes.com for any fees covered on their behalf.
Confidentiality
All arbitration proceedings and related awards shall remain strictly confidential, except as necessary for court enforcement or legal compliance. Confidentiality shall extend to attorneys, tax advisors, senior management, and individual parties’ family members, if applicable.
Severability
If any portion of the arbitration agreement is deemed invalid or unenforceable, the remaining sections shall continue to be in effect. However, if the provision prohibiting class or representative actions is found unenforceable, then the entire arbitration agreement shall be void, and any related disputes shall be resolved in a court of competent jurisdiction.
